What Changed for Buyers in 2026
The single biggest shift this year is on the tax side. Under Decreto-Lei 97/2026, a buyer who is not a Portuguese tax resident on the purchase date now faces a flat 7.5% IMT (property transfer tax) on residential property, instead of the old progressive scale. Add the 0.8% stamp duty and your acquisition tax lands near 8.3% of the price.
That charge can be reversed if you become a Portuguese tax resident within two years, or if you commit the home to affordable long-term rent. The exact entry-into-force was still settling through mid-2026, so confirm the current position with a Portuguese lawyer before you offer.
Madeira also runs its own IMT table: the bracket thresholds sit roughly 25% above the mainland, and an own-and-permanent home is exempt up to about €132,900. It is a modest regional advantage, but it changes the math on smaller purchases.
On licensing, Funchal suspended new short-term-rental (Alojamento Local, or AL) registrations in multi-family residential buildings in late 2025, extended it into 2026, and approved a new municipal AL regulation in June 2026 that keeps limits on apartments in collective-housing buildings. Detached houses (moradias) and rooms in your own home were exempt from the freeze.
The takeaway: any apartment-based rental assumption in Funchal must be checked against the current regulation before you offer. Detached houses in municipalities like Calheta, Ponta do Sol, and Ribeira Brava still offer a cleaner licensing path and stronger premium-rental positioning.
Where Properties Quietly Fail as Businesses
Climate risk: humidity, salt air, and slope exposure accelerate wear on appliances, coatings, metal fixtures, and ventilation. Mainland maintenance assumptions underestimate this every time.
Elevation risk: properties above roughly 300m can lose their winter-sun appeal and convert weaker in the shoulder season. The south coast below that line is the reliable rental belt.
Access risk: steep, pedestrian-only entries and tight parking add cost to every clean, every maintenance call, and every guest arrival.
Licensing risk: in a shared building, a condominium assembly can vote to oppose an existing AL on documented, repeated nuisance grounds (a majority above 50% of the building's quota). Up-front condominium consent is no longer required to start, except for hostels.
The Numbers That Decide Go or No-Go
Build one honest acquisition model before you fall in love with a view. It should include:
Purchase taxes: IMT (the flat 7.5% if you buy as a non-resident) plus 0.8% stamp duty.
Transaction costs: notary and land registry (the Casa Pronta one-stop is roughly €375–€700), legal fees (typically 1%–1.5%), and any survey.
Setup capex: furniture, safety equipment, dehumidification, and the first photography and listing build.
Year-one operating reserve: preventive maintenance, IMI, insurance, and a wear-and-tear fund — not just cleaning and platform fees.
If the deal only works on optimistic occupancy and zero surprises, it is not a deal yet.
